Welcome to 42DOH. These Terms of Service ("Terms") govern your access to and use of the 42DOH website at 42doh.com (the "Site") and the products, applications, and services offered by 42DOH ("we," "us," or "our"), including HireAnAier, Toxic Holden, and Radio 1978 (collectively, the "Services"). By accessing or using the Site or any Service, you agree to be bound by these Terms.

1. Relationship to product-specific terms

42DOH offers multiple products, and individual products may have their own additional or superseding terms, agreements, and policies (for example, HireAnAier maintains its own product-specific terms and conditions, including paid-service and subscription terms). Where a product has its own terms, those product-specific terms govern your use of and any purchases made through that product. These company-level Terms apply to the Site and to any Service that does not have its own separate terms. In the event of a conflict, the applicable product-specific terms control with respect to that product.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, and able to form a binding contract to use the Site and Services. By using the Site, you represent that you meet these requirements.

3. Accounts

Some Services require an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You agree to provide accurate information and to keep it up to date. Notify us promptly of any unauthorized use.

4. Acceptable use

You agree not to misuse the Site or Services. In particular, you agree not to:

• Violate any applicable law or regulation, or infringe the rights of others;
• Attempt to gain unauthorized access to our systems or interfere with their operation;
• Upload malicious code or use the Services to transmit harmful, fraudulent, or unlawful content;
• Reverse engineer, scrape, or copy the Site or Services except as permitted by law; or
• Use the Services to harass, abuse, or harm another person.

5. Purchases and payments

Paid Services are billed through our third-party payment processor, Stripe. By purchasing a paid Service you authorize us and our processor to charge the applicable fees to your payment method. Pricing, billing frequency, and the specific terms of any paid Service are described at the point of purchase and in the applicable product-specific terms. Refunds and cancellations are addressed in our Refund & Cancellation Policy and in the product-specific terms.

6. Intellectual property

The Site and Services, including all content, software, trademarks, and logos, are owned by 42DOH or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for their intended purpose, subject to these Terms.

7. User content

You retain ownership of content you submit to the Services. By submitting content, you grant 42DOH a worldwide, non-exclusive, royalty-free license to host, store, and process that content solely as necessary to operate and provide the Services. You are responsible for ensuring you have the rights to any content you submit.

8. Third-party services

The Services may link to or rely on third-party products and services. We are not responsible for the content, policies, or practices of third parties, and your use of them is at your own risk and subject to their terms.

9. Disclaimer of warranties

The Site and Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.

10. Limitation of liability

To the maximum extent permitted by law, 42DOH and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from or related to your use of the Site or Services. Our total liability for any claim will not exceed the amount you paid us, if any, in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless 42DOH from any claims, damages, liabilities, and expenses arising out of your use of the Services or your violation of these Terms.

12. Termination

We may suspend or terminate your access to the Site or Services at any time, with or without notice, if you violate these Terms or if we discontinue a Service. Provisions that by their nature should survive termination will survive.

13. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in California for any dispute not subject to arbitration or product-specific dispute terms.

14. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date above reflects the most recent changes. Your continued use of the Site or Services after changes take effect constitutes acceptance of the updated Terms.
